Terms and Conditions
We want you to love your Roughdiamonds.dk-piece just as much as we loved creating it. Below you find the terms and conditions that you agree to when using our website and when you purchase a unique piece of jewellery from our Web Shop and in our physical boutique. If you, however, are not satisfied with your purchase from our Web Shop then please follow our guidelines for returns and reimbursement below.

These terms and conditions apply to consumers who purchase products from this Web Shop, which is owned and run by Roughdiamonds.dk ApS registration no. 38479342, Bredgade 56 (hereinafter “Roughdiamonds.dk”, “we” or “us”).

Cookie Consent
Cookies are small text files that are downloaded to your computer, mobile device or tablet when you visit a website or mobile application. This allows our website to recognize your devices. The cookies are used to make the platforms work, improve the experience of the website and for analytical purposes for us to better understand how our website is used. This means that cookies are stored by parties other than us.

Cookies are created and stored for different periods of time. Session cookies only exists as long as you visit our website and are automatically deleted when the browser is closed. Permanent cookies are stored after the browser is closed and are used to recognize your computer, mobile device or tablet when you browse the Internet again.

We have implemented a Facebook Pixel on our website to make sure, that we only show you relevant one-of-a-kind pieces when we once in a while advertise on Facebook. The Facebook Pixel is a JavaScript that is installed on our website which triggers an image call to a Facebook server. Facebook then returns with a one-pixel image and puts a cookie on the device of the website user. That cookie is the basis for any subsequent tracking by Facebook, who are then responsible for the protection of your personal data and compliance according to the EU legislation on General Data Protection Regulation (GDPR).

You have the right to choose whether or not you want to accept cookies. However, this may affect the performance of the website. To do this, you need to follow the instructions specified by your chosen browser. This is usually found within “Help”, “Tools” or “Edit” sections in the browser.

Purchase in our Web Shop
When your order has been placed, you will receive an order receipt by email, but this is not a binding order. This is not an order confirmation and we are not bound by your purchase order at this stage. A binding agreement is made between you and Roughdiamonds.dk when you receive a personal order confirmation from Roughdiamonds.dk. This is in case of an error or if the one-of-a-kind piece of jewellery has been sold in the meantime in the Hidden Boutique.

It is your responsibility to ensure that all information that you provide to us is correct, as we do not validate such information.

Payment in our Web Shop
You cannot be invoiced for more than the amount you have approved and which appears on the order confirmation.

All prices shown on the Web Shop are including VAT (25 %) and delivery costs is our service to our clients. Prices are shown in Danish Kroner.

Please note, from the 1st July 2021 eCommerce purchases are required to charge the VAT rate based of the buyer’s shipping country on all orders within the EU.

Non-EU residents will pay excluding the Danish 25% VAT based on the shipping address being outside EU. You may be liable to pay local customs duty/VAT when receiving the piece.

Purchase price will change after selecting your shipping address.

We accept the credit cards shown at the check out page of our Web Shop.

When using a credit card, payment takes place immediately upon invoicing.

We handle your credit card information with confidentiality. When you initially provide or update your payment information, we transmit it via an encrypted connection to our Payment Processor, Stripe. Stripe uses and processes your payment information in accordance with their Privacy Policy. We do not store your payment information, other than your zip code and country, which we require for billing and to comply with tax and other government regulations.

All customers paying by card are subject to validation checks. We reserve the right to delay any order if fraud is suspected.

Delivery
If your order requires delivery to another EU country than Denmark, the regulations regarding the free movement of products apply, so you will be liable to pay your local destination VAT but no customs duty (The Danish 25% VAT will be deducted as well). If you order from outside the EU the Danish VAT will be deducted after applying the shipping address outside EU and you may be liable to pay local customs duty/VAT.

All products are delivered by FedEx where possible.

Free insured shipping on all orders.

If the order contains more than one item, we ship the order when all items are available unless other arrangement has been agreed upon.

Right of Withdrawal
You are entitled to withdraw from your purchase order within 14 days counted from the date when the products were delivered to you. You may exercise your right of withdrawal without stating any reasons by sending us a notification by e-mail.

Please note that you may not exercise your right of withdrawal by refusing to receive the product or by not collecting your product from the carrier.

Please include your order number in the notification, so we can avoid delays and errors.

The right of withdrawal does not apply to products made/personalized to your specifications. This includes, but is not excluded to, custom made pieces or any changes at all made to the original piece, such as lengthening or shortening of chains or resizing of rings.

You must send back the product to the same address no later than 14 days from the day on which you communicated your decision to withdraw from the purchase agreement. 

We may ask for documentation showing, that the product(s) have been shipped before the expiry of the deadline.

International orders must be returned to us via courier service to ensure that they are protected and insured during transit. Return freights must be paid by you.

Any returns by delivery must be properly packaged. You are responsible for any incurred damages during the transportation of the products unless the product was mistakenly delivered to you or if the product was already damaged when it was delivered. You shall bear the cost of returning the product(s). It is not possible to determine the cost for returning the product(s) in advance as this depends on the weight of the package and choice of transportation etc.

Returned product(s) should be in good, undamaged condition. This includes the original box and signature Roughdiamonds.dk bag. You are, in other words, allowed to try on the piece of jewellery as you would in our physical boutique but you cannot take it in actual use. If the piece(s) has been worn beyond what is described above, we consider it as used, which means that you by withdrawal might only get part or none of the purchase amount back depending on the commercial value.

You are, therefore, liable for any diminished value of the product(s) resulting from the handling beyond what is necessary to establish the nature and functioning of the product(s).

All payments will be reimbursed no later than 14 days from the day you notified us on your decision to withdraw from your purchase. We, however, reserve the right to withhold payments until we have received the product for inspection.

Unless you have stated otherwise, we will reimburse you by using the same means of payment that you used for the initial transaction. We do not reimburse fees on the use of credit cards or other payment instruments.

Complaints
There is a 2-year warranty on any products purchased from Roughdiamonds.dk. 

The warranty is the client’s right to complain about a piece that has defects or deviancies that was present when the product was sold. For the first six months of the warranty the burden of proof is with Roughdiamonds.dk and for the next 18 months it falls to the client. 

Should the piece of jewellery against all expectations break during the warranty period, the cost of repair or exchange is ours, except if the damage is caused by faulty use, handling errors, modifications by second party or gross misuse by the client, then the repair or exchange is not covered by the warranty. We professionally inspect the piece(s) of jewellery upon return and if we conclude the piece has in any way been misused or mishandled the repair must be paid by the customer regardless of the two year warranty.

When returning the piece of jewellery, please enclose your invoice number and a note stating the nature of your complaint.

How we store your data
We collect and use information about you to ensure you will have the best possible experience with us when you buy your one-of-a-kind piece of Fine Jewellery. All data that you voluntarily provide us when purchasing from us – either at our Web Shop or in our physical boutique – is encrypted and stored in a password protected database with restricted access.

The data you provide us with are stored to ensure you the best possible service now and in the future. Our records of your personal information are kept safe and protected until you request to have them deleted.

How we use your data
When you make a purchase at our boutique or in our web shop, we will collect information necessary for us to fulfil your order.

When you pay by card, we collect your payment information in order for us to process the order. All credit card information is handled with the utmost confidentiality. When you provide the card information it is transmitted via an encrypted connection to our Payment Processor, Stripe for our online Web Shop and Elavon for our physical boutique. Stripe and Elavon uses and processes your payment information in accordance with their Privacy Policy and according to the EU General Data Protection Regulation. We do not store your payment information, other than zip code and country, which we require for billing and to comply with tax and other government regulations.

All customers paying by card are subject to validation checks. We reserve the right to delay any order if fraud is suspected.

When you place an order with us or otherwise need services, such as resizing or repairs, we will need to take additional contact details and delivery information, such as address and telephone number, from you so we can complete your order. We use third party couriers to deliver your order and will need to share your contact information with them for this purpose. Everything is treated with utmost confidentiality and in compliance with GDPR.

We Never Sell Your Personal Information
All personal information collected is used for our internal use only. We do not rent, sell or share personal information about you or non-affiliated companies except when absolutely necessary under the following circumstances:
· Third parties who provide services on our behalf such as online and other payments, processing credit card transactions, handling credit checks and fraud preventions. 
· Third parties who provide services on our behalf online, such as our website hosts Squarespace and Wordpress and our newsletter, which is sent via Mailchimp. Everything is treated with confidentiality and in compliance with GDPR.
· Third parties who provide services on our behalf such as courier delivery services.
· We may disclose your personal information to any law enforcement agency, court regulator or government authority if we believe it necessary to comply with legal or regulatory obligations.

How To Access, Correct, Limit, Object Or Delete Your Personal Information
You have the right to request access to any personal information that we have about you in our records and to know the purpose of the registration, where it originates from and the categories of the personal data.

You are entitled to correct any inaccuracies or update any out-of-date information we have stored about you.

You have the right to have any of your personal information deleted altogether. If you wish to do so, then let us know and we will delete any information we have on you save by those required by the law. 

You may be entitled to limited treatment of your personal information. In these cases we will only be able to process your information, with the exception of storage, with your consent or if a legal claim should arise and needs to be enforced or defended, or for the protection of important social interests or a person.

You have the right to object to our processing of your personal data.

You have the right in certain cases to receive the personal information we have stored on you in an easily accessed and machine-readable manner. You also have the right to transfer such data from one data manager to another without any delay or hindrance.

Disclaimer
As with our diamonds, we cannot promise that our website will be free of mistakes, inaccuracies or typographical errors at all time. Neither can we guarantee that all information is up-to-date, as all our jewellery is one-of-a-kind. We may at any time amend the content of our Web Shop.

Roughdiamonds.dk always strive to display the right images, texts and pricing, but errors may occur. If you have been charged the wrong amount in the Web Shop, we will give you the option of placing a new order with the correct price or cancelling your order. We, however, reserve the right to cancel any order prior to dispatch should we find that the purchase is based on erroneous information, including incorrect pricing. In such case we will notify you by e-mail. If we are unable to contact you, your order will be cancelled automatically.
